By accessing the website www.gkero.com you agree to these terms and conditions of use. Please carefully read these terms. By accessing the website you warrant and represent to the Website owner that you are legally entitled to do so, including that you are over 18 years old or have reached full legal age in the country from where you are accessing the website.

If you do not agree to be bound by these terms and conditions you may not use or access this website.

We may change these Conditions at any time without notice. The latest version of these Conditions is available on our Website. The www.gkero.com website is provided solely for your personal use. You may not use this website for any commercial purpose.

1- Scope

These are the terms and conditions of sale ("Conditions") of G.KERO SARL (the company, we, us) registered brands. These conditions will apply to all purchases of goods via our website www.gkero.fr (the "Website"), under the condition that you (the customer submitting an order for goods with no commercial purpose) live in the country from where you are accessing the website when you order via the website; and to all deliveries related to said purchase(s) to the customer or to any third party (named by the customer) residing in the same country with same legal entitlement as the customer. These terms shall apply to all purchases of goods ordered via the website and the customer confirms unconditional acceptance of these conditions when confirming an order on the website.

We may change these conditions at any time without notice. The latest version of these conditions is available on our Website. Conditions applying are those in effect on the day of the purchase(s).

3- Information on the Website and disclaimer of Liability

Every care has been taken to ensure that the photographic representation, description and specification of each product are accurate. However, while the reproduction of colours is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. The Company shall not be responsible for such discrepancies. G.KERO SARL only has a best effort obligation and shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In particular, neither the Company nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof, nor in case of force majeure as defined by Law.

G.KERO reserves the right at any time to change or discontinue without notice, any aspect or feature of this website and Conditions. All provisions of any relevant terms and conditions, policies and notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. We may change these Terms and Conditions at any time. If any of these terms and conditions is invalid or unenforceable, the remainder of these terms and conditions shall continue to have full force and effect.

4- Orders

Orders may only be placed by legally authorized Customers aged 18 and over, holding a personal bank credit card (Visa, MasterCard, Carte Bleue) with exclusion of any other means of payment. All orders are subject to availabilities. Customers have access to stock availabilities and product descriptions on the Website. Should one product be out of stock, the Company will rapidly advise Customers by email and will issue a refund of the exact corresponding price to the original card that was used for the purchase or may suggest to the Customer to amend placed order according to stock availabilities.

The Company reserves the right to refuse your order request should your payment records be unsatisfactory. Failure to meet the eligibility to order criteria set out in the Terms and Conditions may occur. In this case, the Company may advise you by phone or email within six (6) days after you placed your order. The absence of action or inappropriate action shall result in the pure and simple cancellation of your order.

G.KERO reserves the right to remove at any time any product displayed on the Website and also the right to modify any content or information related to any product.

5- Use of your information

When you place orders on our Website, we collect certain personal and transactional information (i.e. name, address, email address, phone number and credit card details) from you so that we can process, fraud check and deliver your order. Details of your address and also the telephone number and email you have provided us will be shared with our courier partner; these details have been shared to assist in providing you with 1st class delivery service and will not be used by this third party for any other reasons. These details allow us to process your order and to let you know the status of your order. In accordance with Law of 6th January 1978 regarding Information Technology and Privacy, amended 6th August 2004 (French Law), all customers may alter, oppose and have access to their personal information. If you wish to do so, please send the Company an email with your name, surname, email address and postal address to: contact@gkero.fr

The confirmation of an order, orders and invoices are registered on the records of G.KERO, which are stored on a reliable and sustainable support. The Customer accepts that the confirmation of an order is considered to be proof of the contractual relationship between the Parties. The computerized record stored by G.KERO will be accepted by the parties to be proof of the communications, orders, payments and transactions occurring between them.

6- Online orders on our Website

The customer shall carefully follow the instructions on the Website when placing orders to ensure proper processing.

7- Order Acceptance

Emails and Website records are proof (order acceptance, payment, order date and content) between you and the Company.

8- Price

Unless otherwise stated, all prices on the Website are in Euro (EUR).

In accordance with applicable law and regulations in force, all purchase(s) via our Website from countries belonging to European Union are subject to the value added tax (VAT). Therefore, in accordance with Chapter I of Title V of the Council Directive 2006/112/CE on the common system of value added tax, the place of dispatch is deemed to be the address in the Member State where the Goods are delivered and the applicable VAT thereof will be the current established VAT of each corresponding Member State where the Goods are received, according to the purchase order(s). In accordance with applicable current regulations of each country, the regulation in Article 194 of the Council Directive 2006/112/EC may apply to Goods supplied in certain Member States of the European Union whether the Customer is or should be liable for payment of VAT. In this occurrence, no VAT will be charged to the Customer provided that the receiver of the Goods confirms that the VAT corresponding to the received Goods will be recorded by the Customer as specified in abovementioned Article 194.

Items are invoiced and therefore payable on the basis of the price in force at the time of ordering. Delivery charges will automatically show on the detailed order and will be indicated on the electronic order confirmation. An invoice detailing price of each item, delivery charges and VAT amount (in local currency) will be available on the Customer online account on the Website.

International purchase outside the European Union:

Please note that any purchase from countries outside the European Union is without VAT.

Custom fees may be applied by countries of destination.

9- Payment

You must pay the Goods by credit card prior to their dispatch.

The purchases shall be settled either via Paypal, or via the secure platform provided by CREDIT MUTUEL CITELIS (French bank).

In the event that the sum due cannot be debited for whatever reason (including, without limitation, stopped payment, refusal by the bank/card issuer) the order will be cancelled immediately. The payable amount is indicated in the electronic order confirmation. Your credit card will be debited immediately on the Internet.

10- Secure Payment

www.gkero.com is linked with CREDIT MUTUEL CITELIS secured payment interface. On payment you will be linked to the secured CREDIT MUTUEL CITELIS payment platform using the industry standard encryption protocol known as Secure Socket Layer (SSL) to keep your information secure. www.gkero.com never has access to you bank details.

11- Delivery

The order submitted by the Customer will be processed only after full payment. It will be dispatched at the delivery address given by the Customer. Parcel will be sent with a packing list and invoice at the delivery address given by the Customer.

All orders are confirmed by email and put in delivery the day after your order.

11-1 Standard delivery in Metropolitan France:

For deliveries in France shipping is free and handled by DHL

In case of non-delivery your parcel will be returned to our warehouse.

We will contact you by email to give you the reasons for non-delivery. We may ask you to confirm delivery address and plan a new date for dispatching the Goods. In case of non-delivery due to invalid information provided by the Customer (including, without limitation, address not valid, wrong postal code, no door code provided, staircase number or name not provided, wrong name on site &), the delivery will be delayed. The Company shall not be responsible for such inconvenience.

11-2 Deliveries outside Metropolitan France:

All ordered items from a country outside France is shipped with DHL.

The shipping cost for Europe is 20 euros.

The shipping cost outside of Europe is 30 euros.

Your order is put to delivery within 24 hours. DHL will then deliver your order from 24h to 4 days depending on the country.

For EU countries it is generally 24 hours after setting in delivery.

For US it is 48 hours to 3 days once the ordered item is put to delivery.

We put the ordered items to delivery process within 24 hours after receiving your order (working days only which except Saturday, Sunday, and public holidays)

DHL is responsible for picking up your parcel from www.gkero.fr warehouse and for the delivery at the defined Customer’s delivery address. It is a 24H delivery approximately for all EU countries. And 48 hours to 5 days worldwide depending on the countries. Your parcel is delivered during working hours, between 9:00 am and 6:00pm.
The Customer has to provide a valid telephone number and detailed address with floor, building name or number and door code if need be. One sole carrier is in charge of the delivery. In case of absence, the carrier will leave a slip with plan of date and time range for next delivery. The Customer may call DHL Customer Service to change date and time range should the one indicated on the slip be inconvenient. After 3 non-deliveries, the pending delivery parcel is kept in the nearest DHL office. For your convenience, the parcel may be delivered to a neighbor; the carrier will notify the Customer on the delivery slip and it will be indicated on your online delivery follow up.

Do not accept a damaged parcel (parcel that has been visibly open or damaged). Parcels are faultless when leaving G.KERO SARL warehouse and should be in the same state when delivered to the Customer. Should you receive a damaged parcel in your mail box or should your keeper sign for a damaged parcel without inspection nor notification then the parcel is considered valid and accepted and we would not consider the damage or potential loss and therefore would not accept any refund claim a posteriori.

Whilst every effort is made to accurately and efficiently process your order, products may be missing in your delivery. Also, due to the transportation, a product may be delivered faulty. That is why we recommend that you inspect the Goods in the parcel at the time of the delivery. In case of faulty delivery (missing item, faulty item, damaged parcel), advise by recorded mail our Customer Service on the day of delivery or at the latest, on the following working day (to eshop@gkero.fr). Any later claims shall be lawfully refused by G.KERO SARL who shall not be liable for the damage. G.KERO SARL reserves the right to request the return of faulty items to their warehouse. Should the aforementioned conditions be fulfilled, G.KERO SARL will edit a credit note for the refund of the faulty item(s) or organize the delivery of the missing item(s) for legitimate claims.

12- Cancellations and Returns Policy

12-1 Standard Returns Policy:

Subject to the European Parliament and Council Directive regulating Consumers rights, the Customer has fourteen (14) clear days after reception of the Goods in which to exercise his right of withdrawal without giving a reason therefor or incurring a penalty. Within twenty-eight (28) days {as fourteen (14) days add on to the fourteen (14) days withdrawal delay}, the Customer can return the delivered Goods in their original packaging, complete with tags and any related accessories or instruction booklets, together with the filled out return slip.

The cost of returning the goods shall be borne by the Customer. A refund (excluding the return delivery charges) will be issued to the means of payment used for the purchase, within three (3) working days following the delivery of your return parcel in our warehouse or upon receipt of its delivery proof.

Damaged articles, not in the same condition as when sent originally as well as worn and washed items, will not be reimbursed.

13- Exchange of Goods

Please note we do not accept item / color / size exchanges.

On delivery, the Customer has to check that the Goods received comply with the placed order.

Exchange of Goods and refunds in case of faulty items of non-compliance.

The Customer shall advise G.KERO SARL of the non-compliance of the Goods of the contracted order within 7 days after delivery by email to eshop@gkero.fr. On the Company agreement, the Customer shall return the Goods in their original packaging, complete with tags and any related accessories or instruction booklets, together with a copy of the original invoice to GKERO SARL, 12 rue du Sentier 75002 Paris, FRANCE.

It is the Customer’s responsibility to obtain proof that the goods have been returned, by returning the items by registered post or by such other means which gives proof of date of postage and delivery. Should the non-compliance result in a human error from our part or in the delivery of a faulty item, we will bear the cost of the return. In all other instances, the cost of returning the goods shall be borne by the Customer. G.KERO SARL shall exchange the faulty item(s) or shall issue a refund, in accordance with the Customer’s choice. In the instance that the Goods cannot be exchanged, a refund will be issued by the Company to the original card that was used for the purchase within 30 days of receipt of the return in our warehouse, such refund will include the delivery charges should the complete order be faulty.

Notwithstanding the specific warranties delivered to the Customer for a specific delivered product, the Goods sold buy the Company comply with legal warranties of European parliament and Council Directive 1999/44/EC.

14- Intellectual Property Rights

The Website remains the exclusive property of the Company G.KERO SARL. This website and its content including all text, graphics, logos, button icons, images, data compilations and software used in connection with this website, is our property or that of our suppliers and is protected copyright, trademarks, database rights and other intellectual property rights. Any attempt to access the Website source code and protocols or any reproduction, whether complete or partial, modification or use of these marks, illustrations, images and logos, for whatever reason and in whatever medium, without our written, express and prior agreement, is strictly prohibited.

Any copying, reproduction or fraudulent use through any means is considered as counterfeiting and the counterfeiter’s civil and/or criminal liability may be held. G.KERO SARL reserves the right to claim for compensation for the recognized prejudice.

You hereby acknowledge that G.KERO Website (www.gkero.com) and its content are protected copyright, trademarks, patents rights, database rights and other lawful intellectual property rights.

15 - Guarantee

All products are covered by the legal guarantee of conformity (French Consumer Code) and the guarantee against hidden defects (French Civil Code). Theses guarantees will only apply if the buyers reacts during a period of 2 (two) years after the delivery date (guarantee of conformity) or after discovering the hidden defects (guarantee against hidden defects).

16 - Applicable Laws

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of the French Republic without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of France in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
